The Supreme Court of the RoC, at the session of the Panel held on 28 January 2009, rejected the appeals and upheld the verdict of the War Crime Council of the Sisak County Court, passed in the repeated proceedings, which found the defendants Janko Banović and Zoran Obradović guilty of committing a war crime against civilians referred to in Article 120 paragraph 1 of the Basic Criminal Law of the Republic of Croatia (OKZ RH) and sentenced them to 5 years in prison each.

The 1st defendant Janko Banović is at large and he was sentenced in absentia. The 2nd defendant Zoran Obradović is in detention.

INDICTMENT

The indictment of the Sisak County State’s Attorney’s Office No. K-DO-7/05, dated 2 March 2007, modified at the main hearing held on 21 August 2007.

VERDICTS

On 31 August 2007, the defendants Janko Banović and Zoran Obradović were found guilty and sentenced to 7 (seven) years in prison.

The Supreme Court of the RoC (at the public session held on 21 January 2008) quashed the verdict of the Sisak County Court published on 31 August 2007.

In the repeated proceedings held on 19 June 2008, the War Crime Council of the Sisak County Court published a verdict, which sentenced the defendants to 5 years in prison each.

The Supreme Court of the RoC, at the public session held on 28 January 2009, rejected the appeals and upheld the verdict by the War Crime Council of the Sisak County Court.
